Public Statement in relation to Mr Nicholas Macdonald
Under section 41A(2) of the Health Care Complaints Act, 1993 ('the Act'), the Commission has made a prohibition order and decided to issue the following public statement under section 41A(2)(b) of the Act:
The Commission concluded an investigation into the professional conduct of an anaesthetic technician, Mr Nicholas Macdonald. The investigation found that whilst working casual shifts as an agency anaesthetic technician at two different facilities, Mr Macdonald breached Clauses 3(1), 3(9) and 8(1) of the Code of Conduct for Unregistered Health Practitioners (‘Code of Conduct’) by failing to provide a health service in a safe and ethical manner, providing a health service under the influence of a drug he was not prescribed and practising while suffering an impairment, namely abuse of the drug Propofol, that detrimentally affects or is likely to detrimentally affect, his ability to practice or that places clients at risk of harm, in that:
- in the course of working as an anaesthetic technician at Hospital A on 30 August 2013 and before the end of his shift, he misappropriated an ampoule of Propofol, a syringe and needle and self-administered the drug in a staff toilet
- in the course of working as an anaesthetic technician at Day Surgery B on 8 October 2013 and before the end of his shift, he misappropriated two ampoules of Propofol, a syringe and needle, self-administered half an ampoule of Propofol and returned to his duties under the influence of the drug.
The Commission makes a prohibition order under section 41A(2)(a)(i) of the Health Care Complaints Act 1993 permanently prohibiting Mr Macdonald from practising as an anaesthetic technician, in either a paid or voluntary capacity, or working in any other position where he has unsupervised access to drugs or medication.
The Commission also makes its Statement of Decision publicly available under section 41B(3)(c) of the Health Care Complaints Act 1993.
