The Health Care Complaints Commission recently prosecuted a complaint against Dr Derrick Perera before the NSW Medical Tribunal. The complaint related to an alleged breach of professional boundaries when Dr Perera tried to kiss a female patient during an examination.
The patient complained to the medical centre and police. Dr Perera was charged by police with assault with an act of indecency. The charge was dismissed.
Dr Perera denied the allegation. However, the Tribunal accepted that the patient was a credible and convincing witness who had no reason to fabricate the events. For this reason, the Tribunal preferred the patient’s version of events. On 23 September 2009, the Tribunal found Dr Perera guilty of professional misconduct. Dr Perera was reprimanded and the Tribunal imposed several conditions on his registration to practise.
