Public Statement in relation to Mr Robert William Jarvis

On 1 August 2011 the Health Care Complaints Commission concluded its investigation into Mr Robert Jarvis, naturopath, and found that he had breached the Code of Conduct for Unregistered Health Practitioners.
The investigation was the result of a complaint made to the Commission by a female patient of Mr Jarvis in relation to inappropriate comments and treatment during a consultation.
Under section 41A(2) of the Health Care Complaints Act 1993, the Commission has made a prohibition order and has decided to issue the following public statement:
The Commission has concluded an investigation into the care provided by Mr Robert Jarvis to a patient during a consultation in September 2010. The Commission found that Mr Jarvis breached the provisions of the Code of Conduct for Unregistered Practitioners during this consultation by:
- asking inappropriate questions regarding the patient’s sexual activity;
- touching the patient’s breasts; and
- failing to ensure that he had any indemnity insurance arrangements in place in relation to his practice.
The Commission has now made a prohibition order under section 41A(2)(a) of the Health Care Complaints Act 1993 prohibiting Mr Jarvis from providing any health service for a period of three years. The prohibition order also specified that, at the conclusion of the three year prohibition period and before providing any health service, Mr Jarvis must satisfy the Commission that he will abide by the Code of Conduct for Unregistered Practitioners and is no longer a risk to public health or safety.
