RN Andrew Moses – Professional misconduct – Reprimand and conditions

The Health Care Complaints Commission prosecuted a complaint against Mr Andrew Moses, a registered nurse, before the NSW Civil and Administrative Tribunal (‘the Tribunal’). Mr Moses allegedly failed to observe proper professional boundaries with a patient at Lakeside Clinic, Warners Bay Private Hospital in 2015. Patient A was highly vulnerable as she had a significant mental health history and it was alleged that he communicated extensively and inappropriately with Patient A via phone and text messages.
The Tribunal decision was handed down in two parts. On 6 May 2019, the Tribunal found Mr Moses guilty of unsatisfactory professional conduct. The decision as to whether Mr Moses was also guilty of professional misconduct was adjourned and ultimately handed down on 19 December 2019. The Tribunal found RN Moses guilty of professional misconduct, having regard to the length of time that he engaged in the relationship with Patient A and in circumstances where it had the potential to cause Patient A harm.
The Tribunal formally reprimanded Mr Moses and imposed health conditions on his nursing registration, including that he:
- attend a psychologist or psychiatrist for ongoing treatment for a period of at least 12 months; and
be subject to mentoring in accordance with the Nursing and Midwifery Council of NSW’s Mentor Guidelines for a period of 12 months.
