Mr Oscar Yildirim – Physiotherapist – Professional misconduct

The Health Care Complaints Commission prosecuted Mr Oscar Yildirim, a registered physiotherapist, before the NSW Civil and Administrative Tribunal (‘the Tribunal’). The complaint alleged that Mr Yildirim was guilty of unsatisfactory professional conduct and professional misconduct in relation to his treatment of Patient A, who attended two consultations with him in 2018. It was alleged that during the course of his treatment of Patient A, Mr Yildirim failed to provide a towel to maintain Patient A’s dignity and modesty and that he also inappropriately touched or moved Patient A’s underwear on a number of occasions. It was alleged that this was conduct of a sexual nature towards Patient A.
On 17 September 2021, the Tribunal published its Stage 1 decision and found that Mr Yildirim was guilty of professional misconduct. The Tribunal found that Mr Yildirim engaged in conduct of a sexual nature towards Patient A.

The protective orders will be determined at a Stage 2 hearing.
