Ms Benju Dulal – Registered Nurse – Reprimand and conditions

The Health Care Complaints Commission prosecuted a complaint against registered nurse Ms Benju Dulal, before the NSW Civil and Administrative Tribunal (the Tribunal). It was alleged that Ms Dulal worked for a six month period between October 2019 and April 2020 in the Emergency Department at a hospital in breach of conditions on her registration. The conditions required that she work under indirect supervision and notify the Nursing and Midwifery Council (the Council) about changing the nature of her work or place of practice.

On 9 July 2021 the Tribunal published its decision which found that Ms Dulal’s actions were improper and unethical and that she was guilty of unsatisfactory professional conduct and professional misconduct. The Tribunal ordered that Ms Dulal be strongly reprimanded and imposed “critical compliance conditions” on her registration. A breach of critical compliance conditions would result in the practitioner’s registration being cancelled.
