Dr Edwina Guard – Medical Practitioner – Unsatisfactory Professional Conduct, Professional Misconduct and Impairment

The Health Care Complaints Commission prosecuted a complaint against medical practitioner Dr Edwina Guard before the NSW Civil and Administrative Tribunal (“the Tribunal”).
It was alleged that between February 2018 and October 2019, while working in general practice at Bowraville and Macksville, Dr Guard:
- Breached conditions of her registration.
- Improperly backdated a prescription of Targin and Endone.
- Failed to respond to a request for information from the Commission.
It was also alleged that Dr Guard has an impairment which detrimentally affects, or is likely to detrimentally affect, her capacity to practise.
On 15 September 2022, the Tribunal found the complaint proven. The Tribunal found that Dr Guard was guilty of unsatisfactory professional conduct and professional misconduct, and that she suffered from an impairment.
The Tribunal will determine protective orders following a further (Stage 2) hearing.
