Mr David Vuong – Pharmacist – Registration Cancelled for Unsatisfactory Professional Conduct and Professional Misconduct

The Health Care Complaints Commission prosecuted a complaint against pharmacist Mr David Vuong before the NSW Civil and Administrative Tribunal (“the Tribunal”).

It was alleged that between 2015 and 2018, while working as a locum pharmacist at Maks Chemist (“the pharmacy”) at Belmore, Mr Vuong:

  • Inappropriately dispensed medications listed in Schedule 4 of Poisons List under s 8 of the Poisons and Therapeutic Goods Act 1966 (NSW) for four patients
  • Participated in the arrangement that Maks Chemist (“the pharmacy”) at Belmore established with a health food store operator at Cabramatta, Ms Trinh, to supply large quantities of prescription medication and pharmaceutical products.

In its decision of 29 July 2022, the Tribunal found the complaint proven. The Tribunal found that Mr Vuong was guilty of unsatisfactory professional conduct and professional misconduct.

The Tribunal cancelled Mr Vuong’s registration with a non-review period of 12 months.
